Marvin Gaye's family sue Robin Thicke

Oct 31 2013, 12:24pm CDT | by Bang Showbiz

Robin Thicke is being sued for copyright infringement over his hit song 'Blurred Lines'.

Marvin Gaye's children have filed legal papers accusing the singer and Pharrell Williams, who features on the track, of copying elements of the song 'Got To Give It Up', according to The Hollywood Reporter.

They are seeking damages and a portion of the profits from the song, which has been one of the biggest hits of 2013.

The lawsuit is in response to a claim brought in August by Robin and Pharrell, asking a court to rule their song did not infringe Marvin's copyright.

In their legal papers - also filed on behalf of fellow collaborator T.I. (Clifford Harris, Jr.) - the trio insisted there were no similarities between the two songs "other than commonplace musical elements".

In the lawsuit, Frankie and Nona Gaye, Marvin's children, allege that Robin more or less admitted to plagiarising their late father's work in interviews.

They also said his 2011 song 'Love After War' amounted to "unlawful copying" of Marvin's 1976 track 'After The Dance War'.

The legal claim argues that record label EMI should have protected Marvin's musical legacy by pursuing a copyright infringement claim, but instead allowed a conflict of interest to arise between the family's rights and the profits it is earning from 'Blurred Lines' sales.

The court documents read: "This conflict has resulted in EMI's intentional decision to align themselves with the ['Blurred Lines'] writers, without regard to the harm inflicted upon the rights and interests of the Gaye Family, and the legacy of Marvin Gaye,"

Sony/ATV Music Publishing, which owns EMI, said it took its role of protecting its songwriters' works from infringement "very seriously".

The company said: "While we have not yet seen the claims by the Gaye family against EMI, we have repeatedly advised the Gaye family's attorney that the two songs in question have been evaluated by a leading musicologist who concluded that 'Blurred Lines' does not infringe 'Got To Give It Up'."

Sony/ATV also said while it treasured the work of the late singer and the company's relationship with his family, "we regret that they have been ill-advised in this matter".

Is 'Captain America: The Winter Soldier' Really Just The Great American Bromance Love Triangle?

Aug 22 2014 7:25pm CDT | Source: Oh No They Didn't!

Captain America: The Winter Soldier is now available for digital download, which means you can relive Captain America’s heroism and Black Widow’s sheer badassery anytime you want. That also means you’ll have the time to read way too much into the Marvel movie — as I did this week.I discovered that Captain America: The Winter Soldier takes the modern conceit of “bromance” to the next level. This isn’t just the story of a friendship ...

Premiere: Auclair - 'Mersea Mersea Me'

Aug 22 2014 10:15am CDT | Source: Clash Music

Wonderfully odd yet contagious pop music...Hailing from London via Canada and Rwanda, Auclair is difficult to define. A multi-instrumentalist, her abilities span styles, disciplines. Hugely talented, it's almost easier to list what Auclair can't do given the breadth of her output. Firmly ensconced in London's (for lack of a better term) avant pop scene, recent recording sessions included co-productions with Marc Pell (Micachu & the Shape ...

Top 40 In A Summer Of Discontent

Aug 19 2014 8:34am CDT | Source: WNYC Music

Those of us who are lucky enough to be technologically interconnected are currently enduring an overwhelming summer of discontent. To say so is to wring the obvious from a cliché. The information so easily available now, jumping onto mobile screens in pulsing letters, makes age-old problems immediate. Racism. Conflicts over land and human rights. Spreading disease. Environmental perils. Famous lives lost; obscure lives made famous through grotesque endings. All of it has happened countles ...

Milk pours out of FKA twigs's fingers, at the end of arms whose soft bulk suggests a kind of ant-strength. The 21 (5) Albums from the 21st Century Every Man Should Hear

Jul 30 2014 9:56pm CDT | Source: Oh No They Didn't!

Remember when we argued about albums? When we listened to them straight through? When the last note of the radio single made us reflexively hum the intro to the next track? Us, too! Believe it or not, that's not all gone. Even in the millennium that brought us quick-and-dirty downloads, these artists created fully immersive musical journeys of the highest order. This is a celebration of our hands-down, most emphatically favorite LPs from the p ...

Kissin’ Pink

Jul 30 2014 9:22am CDT | Source: All HipHop

By all indications, tonight will be a good one for Trey Barclay. Not only did he “rape” his organic chemistry exam, but he finally secured the phone number of his classmate, who, according to Trey, is one “bad bitch.” Thankfully, Trey isn’t plotting the same sort of strategy he used with his exam, but rather a casual outing for drinks at Buffalo Wild Wings during the midweek. Plus, it’s hump-day, which of course is the precursor to Thursday, or what some folks refer to fondly as dir ...
